…to be able to tell our client’s story to twelve strangers we have to intimately know it ourselves. After my client has gone through a full day or more of this psychodrama I can promise you that I am in a much much greater position to understand my client’s story and then convey it to the twelve strangers in the box. I don’t care how many times you have the interview sessions across the desk or on the couches in the conference room or whatever setting, once you do the psychodrama you will learn things that you did not know before, every single time. That has been my experience.

You have an opportunity to both influence the jurors and build your own credibility. The most important thing that we do is spend a lot of time carefully crafting the opening statement, distilling down the essence of all of the information that we learned through discovery, and trying to present an opening statement that is compelling, that will allow the jurors to start pulling for us and will allow the jurors to see us as credible lawyers. 

I think overall in the Workers’ Compensation setting it’s a good thing because… it was created to prevent a situation where injured workers’ have to prove that their employer was negligent and possibly have to file lawsuits and wait years to recover…From the time of filing of the first report of injury to the DHO hearing should only be a month and a half to two months…the process allows us to get relatively quick resolution of these issues.

The good lawyers on either side have figured out roughly where they want to end up and obviously where they are going to start to get there. They’ve already thought through their moves.
