You can’t have an infectious diseases physician for example come in and testify as to the standard of care for an orthopedic surgeon. It has to be someone who is doing basically the same kind of work that the defendant is doing and from a public policy perspective that kind of makes sense. You want someone who does the same sort of work that you’re criticizing so that they know what the rules and the standards are for that kind of work.
